Sujit Choudhry Discusses Separate Sovereigns Exception

The Separate Sovereigns exception is a legal provision that allows an individual to be tried for the same crime twice. The exception allows a person to be tried for the same crime twice where they are tried once at the state and federal level on separate occasions. It is up to the new Supreme Court judge Matt Kavanaugh to decide on whether to uphold or overrule this legal provision.
